Fahda is a seasoned litigator with over 25 years of practice and regularly appears before courts at all levels of the Malaysian judiciary. She advises and represents a diverse clientele, ranging from private individuals and corporate leaders to multinational corporations and public institutions, in high-value and complex disputes. Her practice encompasses commercial and corporate disputes, regulatory and public law matters, as well as disputes arising at the intersection of civil and Syariah jurisdictions.

Fahda commenced her legal career with leading law firms Zain & Co and Tommy Thomas. Over the course of her practice, she has built a formidable litigation and dispute resolution practice, acting in some of the most complex and highly contentious disputes involving substantial commercial and public interests. Her experience extends to cross-border matters involving jurisdictions including the United Kingdom, Singapore, Australia, the United Arab Emirates, Indonesia, Japan and Germany.

Fahda has also been entrusted with matters of significant public and institutional importance.Beyond practice, Fahda is actively engaged in corporate governance, academia and legal thought leadership.

Representative Experience

  • Acted in matters involving cross-border legal issues, including jurisdictions such as the United Kingdom, Singapore, Australia, the United Arab Emirates, Indonesia, Japan and Germany.
  • Appointed as Special Counsel to state governments in Malaysia for commercial and construction disputes, reflecting a rare recognition of expertise among private practitioners.
  • Represented a state government in defending a claim for breach of contract and advancing a counterclaim for breach of contract and unjust enrichment exceeding RM400 million.
  • Acted for a state government in resisting a claim of approximately RM13 billion premised on the tort of misfeasance.
  • Represented five former directors of a public-listed corporation in defending claims for breach of fiduciary duty, while pursuing a counterclaim for abuse of process against thirteen directors amounting to RM514 million.
  • Acted for a corporation in arbitration proceedings involving claims for breach of construction contract and conspiracy to defraud exceeding RM71 million.
  • Represented a corporation in claims arising from breaches of shareholders’ and subscribers’ agreements, including unjust enrichment and conspiracy, against a private hospital and its directors.
  • Acted for an award-winning animation company in defending copyright infringement claims.
  • Represented a state government in a RM1.01 billion dispute arising from a tripartite concession agreement.
  • Acted for a government-linked corporation in defending a RM24 million claim for breach of contract.
  • Represented a foundation in a RM10 million claim arising from a breach of a joint venture agreement.
  • Acted in the defence of a RM50 million claim concerning breach of a development agreement.
  • Represented a corporation in successfully resisting a RM33 million summary judgment application.
  • Acted for a contractor in a claim for breach of an oral contract, including initiating a notable seizure and sale proceeding against a municipal council in Pahang.
  • Represented a member of a royal family in a high-profile custody dispute involving parallel proceedings, including a claim before the High Court of Australia.
